1940 William Horace Kidd v. W. M. Condry Blount Recovery In 1937 Kidd bought a Plymouth from Condry on credit. Kidd traded in a Chevrolet sedan for the new car as down payment. 1940 Paul A. Appleby, Trustee v. Roy C. Norton & D. M. Norton Blount Failure to Pay Norton traded in one car for another, financing it with Southern Finance. He was given a credit for the car, & the contract reflected the credit. However, the total installments he was asked to pay over an 18 month period added up to the total before the credit. Norton stopped paying; the car was repossessed. After repossession he was billed for further amounts, but claims he is no longer liable as he turned the car over to the finance company. East Range: 5

C. left a wife, & many heirs some of which could not be located. A year's support was set aside for the widow, Nancy Townsend. Crawford sued to keep Nancy from making greater claims on the estate. 1940 Edna Axley by next friend v. Ben Satterfield Blount Gambling Satterfield ran a pool hall. Axley's husband, John Ott Axley a minor, gambled at the pool hall. Satterfield encouraged his gambling, even cashing checks for Axley so that he may continue to bet. Edna sued to recover the money her husband lost while gambling. 1940 Bessie Warren v. Edgar McReynolds, et al. Blount Estate Dispute/ Settlement Bessie was exrx. To Delia & J. H. Warren's estates. R. P. McReynolds executed a promissory note to the estates for $18,900 for four tracts of land. Although some payments were made, a substantial debt was owed on the note. R. P. died. 1939 W. M. Condry v. B. L. Martin Jr., et al Blount Non-payment of Bank Note Martin bought a 1936 Chevrolet from Condry. Because Martin had no money to make a down payment, Burl Gregory & Eric Kidd signed a $100 note for him to make a down payment. Martin used the car sometime but was thrown out of work due to the strike at the Aluminum Company of America plant. He returned the car w/the understanding that Condry should hold it for Martin. 1939 Stanley Bird Motor Co. v. John Wilson Blount Failure to Pay John Wilson sued Stanley, Fred, & Harold Bird who were DBA Stanley Bird Motor Company. Wilson had purchased a 1937 Plymouth sedan under a conditional sales contract to be paid in installments. Wilson lost his job, notified the company, then left the car with them until he could resume payments. 1938 State, ex rel. Ruth Cupp v. Clayton Maples Blount Child Support Cupp, a single woman, accused Maples with bastardy and asked the court to recognize him as the father. He admitted to having relations with her, but denied the child was his. Ruth asked for the maintenance of the child until he/she was 12. The child was born January 30, 1935. Ruth filed a pauper oath, which could result in the child becoming a county charge. Hon. Sue K. Hicks (prosecutor at the 1925 John T. Scopes trial) presided. Precedent cited was William Goddard v. 1938 New York Life Insurance Company v. Mrs. Elizabeth A. Caylor et al Blount Insurance Disputes Add. defendant: Mrs. Pernie Chenoweth. The plaintiff holds an insurance policy on James A. Caylor for $2,000, effective March 1922. The defendant was made beneficiary to that policy, but J. A. Caylor reserved the right to change the beneficiary to P. Chenoweth, which he did in 1930 and died in 1934. E. A. Caylor filed for the benefits, claiming the change to P. Chenoweth as beneficiary was made under fraudulent circumstances. 1937 W. B. McMurray v. Bank of Blount County Blount Injunction Pla. is seeking an injunction restraining the def. from attempting to collect on a note, on which the plaintiff is surety. Pla. complains that it was agreed upon that he would endorse a note for P. J. Martel but, due to inexperience with bills and notes, the plaintiff accidently signed his name on the face of the note instead of the back. 1937 Margaret Foster Carpenter v. Ewing Wilder Blount Recovery of Money/ Wages Plaintiff sued to collect on a $150 check drawn by the Wilder Estates, Inc. of Middlesboro, KY by Ewing Wilder. Payment on the check was stopped Plaintiff alleges that Hubert Carpenter had promised her $300 if she would marry him; the check was part of this arrangement. 1937 Hobart Johnson v. City of Alcoa Blount Damages Sixteen year old Frank Johnson suffered a broken neck after diving into a swimming pool operated by the City of Alcoa. Hobart Johnson, as his representative, sued the city for $15,000 in damages. The pool was constructed over a natural stream or other water source, the water piped in from the uphill side, & drained out of the other. Good description of pool area construction. 1937 Ben Martin & Ray Martin v. State Blount Murder During an argument over money, the Martins & Frank Peery assaulted Connie Sullivan (male) with a gun and shot him to death. They were convicted of voluntary manslaughter. Top binding could not be removed w/o damage to the document. Exhibit accompanying Mrs. Sullivan's testimony is a hand-drawn floor plan of the house in which the murder took place. Individuals who were standing in the room are identified by one initial each. 1935 J. D. Bryant, by next friend, Ike Bryant v. Mrs. Carrie H. Beers Blount Injury and Damages Beers, driving recklessly, struck J. D. Bryant, a minor, on a street in Alcoa. The boy was standing at a street corner when Beers ran over him. He suffered great injury and mental anguish, and was permanently disabled. The Bryants sued Beers for ten thousand dollars.
