L & N Railroad Montgomery Damages This suit was filed to recover $20,000 damages for the flooding of plaintiff's house by defendant, causing property damage as well as wrongful death. Def. filled tanks from the Cumberland river, and a large amount escaped washing over plaintiffs lot. The unsanitary conditions created due to this flooding over span of 10 years led to the death of plaintiffs wife, and other family members plus large medical bills for he and children. Plaintiff was indebted to def. in May 1887 for ~$650, in merchandise, shoes & boots to sell over time. Def. claims Plaintiff used a Capt. W.D. Taylors name in his business to acquire and sell goods under false pretenses. This led def. to take out a mortgage on plaintiffs land, which they signed under threat of criminal prosecution.
