Burney here sued to recover equity for services from Atkinson as trustee for Anna Dingee. Thomas F. Pettus died and in his will, he left a share of his estate to Anna. His sons, Stephen Pettus and John H. Pettus were exe. Anna's share went to Stephen but she sued and the share went to Atkinson as trustee. Middle Range: 38

1899 Fire Extinguisher Manufacturing Company v. City of Clarksville Montgomery Breach of Contract The plaintiff company argued it signed a contract with the city of Clarksville to build and sell a hook and ladder firetruck for $2800. The Mayor and Aldermen of Clarksville attempted to back out of the contract and argued the fire committee did not have the authority to approve the contract. The plaintiff company sued for breach of contract. Austin Peay was head of the fire committee that approved the contract. Middle Range: 38

1899 Charles Perkins, for the use of A. C. Burchett v. Red River Iron Company Montgomery Payment for Services Perkins was employed at the RRICo. After each day, employees were provided slips of paper that showed the amount they were owed for that day's work. These papers were redeemable for cash one day per month. Local businesses started accepting these time slips as cash, redeemable for goods and services. This case was filed after Perkins bought goods from Burchett with his time slips and the RRIC refused to honor them, arguing they had no work agreement with Burchett. Middle Range: 38

1899 C. G. Matthews, agent v. John Herning Montgomery Damages Add plf: Etha Matthews. C. G. hired Herning to drive to Hopkinsville, KY, seemingly to deliver rugs. He gave him a trap, a vehicle driven by two horses, which belonged to Etha. The trap was wrecked half way to the destination and Matthews sued for damages. 1899 A. B. Wimberly, admr. of Joe Daniels v. The Louisville & Nashville Railroad Co. Montgomery Damages for Wrongful Death Wimberly brought an action of damages for $10,000 on behalf of the estate of Daniels dec. 1898. Daniels worked for a coal dealer in Clarksville. Daniels was shoveling coal from one rail car to another when the car was struck by an engine and Daniels was thrown to the ground. He received injuries he later died from. 1898 Wertheimer-Swartz Shoe Company v. H. Lowenthal et al. Montgomery Replevin Add defs: L. and Mrs. A. Lowenthal. In 1895, B. B. Williamson, a traveling salesman of plaintiff Co. sold to H. Lowenthal a bill of shoes for $400 and later another bill of $50 and both lots were received by him. A few days later, H. sold the shoes along with other stock of goods to his brother L. and Mrs. A. Lowenthal. Plaintiff argued that this sale was made to defraud them of their goods and here filed a bill of replevin to reclaim their shoe stock. Middle Range: 37

1898 V. R. Harris v. W. N. Thomas, Fannie Thomas Montgomery Land In 1877, Harris and S. M. Allen were bondsmen for J. M. Newberry, "guardian for a lunatic, Rebecca Buchannan." Newberry came into possession of Buchannan's property. Buchannan, by next friend William Davidson, sued Newberry, Harris and Allen. Newberry was insolvent and Allen had died so Harris paid back Buchannan. Newberry had conveyed Buchannan's land to Allen. Upon his death, the land went to his daughter Fannie. Harris here sued Fannie to sell the land in order to pay him back for paying Buchannan Middle Range: 37

1898 Ussery & Gholson, exe. v. J. J Crusman et al. AND Thomas H. Elliot v. N. L. Carney, admr. et al. Montgomery Default on Promissory Note Crusman and Bryce Stewart began a limited partnership in a grocery firm in 1891. Stewart died in 1894 and Carney was his admr. Notes were executed by Crusman prior to and after Stewart's death including to B. W. Ussery and Elliot. Ussery died, leaving B. R. Ussery and A. R. Gholson, as admrs. of his estate, to file suit to collect the unpaid debt from the estate of Bryce Stewart. See also, Wathen v. Carney in same box and J. J. Crusman and N. L. Carney, admr. v. In 1896, Smith had purchased two pool and billiard tables in installments from J. C. After J. C.'s death, his son C. 1897 Will Harvie [Will Harvey] v. N. J. Lyle Montgomery Equity Harvie and his brother John were the tenants of Lyle and raised crops of corn and tobacco on Lyle's farm. Lyle furnished supplies and agreed to be paid back out of the crop next year, 1896.
