1858 George P. Rutledge v. William W. Lawrence Blount Other Rutlege sold tract of land to Stone in Blount Cty for $10,000. Lawrence purchased land from Stone and became paymaster of $5000 of the note. However, TN was part of the Confederacy at the time of Lawrence's purchase. Confederate Gen Kirby Smith, called for the arrest of any who refused payments of CSA currency. Lawrence offered Rutledge a partial payment in US dollars, and the rest in CSA. Complainant felt he was coerced. Cause: sale under duress. See box ET 17 also. East Range: 5

1858 Ann James, admr. of William James, dec. v. Robert James Blount Estate Dispute Robert James father of William James, dec. Dec. 1852. James's arrived in Blount Co. from England ca. 1847 & established a factory called Chilhouse. Ann James widow of William; the two married in England, which the James's continued to visit often. Plaintiff alleges that since her husband's death she has come to suspect there are "secret partners" in the business & that Robert James is attempting to defraud his creditors, & deprive her of her rights as his son's widow. 1858 Anderson L. Taylor v. Milas Hooper Blount Trover Dr. Taylor says Hooper took & converted to his own use a 1-yr old bay colt with a blaze in his face & 1 white foot. Justice of the peace awarded Taylor $45; appealed to Circuit. Witnesses: Hooper came to Taylor's house w/M.G. Sprinkle, Hugh Bogle & Samuel McAnnally & took colt out of Taylor's lot. Hooper's defense was that the ordinary constable had gone to the South w/horses & in his absence, Hooper was deputized & in that capacity levied on the horse to satisfy judgments Sprinkle had against Taylor. 1858 Alexander Ish, Jesse Kerr, et al. v. Knoxville & Charleston Railroad Co. Blount Injunction Additional Plaintiffs: H. T. Cox; William Kerr; J. Coulston; M. H. Stephens; W. W. Bayless, et al. Plaintiffs seek an injunction preventing the construction of the railroad. Argue that the TN legislative act of 1854 which ordered the Blount Co. Court to subscribe $120,000 in county bonds for its construction was unconstitutional. Mistrial declared, then disputed land surveyed, then jury ruled in favor of Bogle & Best. Claims of both parties were based on grants from State of Tennessee. 1855 A. L. Taylor v. Hiram Bogle Blount Failure to Pay Hiram, his wife Martha Ann, & his child, & "a young black woman" in their household became ill. They called Dr. A. L. Taylor to take care of him. Each family member repaired at a different rate of time, the total time of the Dr.'s attention was about two months. The bill mounted & Bogle could not pay it back right away. Suit was to recover payment. However, witness testimony shows the bill was far too high to be fair. East Range: 5

1851 Clement H. Saffell, admr. of Margaret McElwee, dec. v. James K. Cox Blount Slaves, Ownership of Margaret McElwee married James McElwee, 1811. Separation not long after marriage. Margaret gained possession of slaves. Nephew, John Cox and Samuel Saffell (husband of her niece) acted as consultants on her estate. Dispute over ownership of slaves. Slaves: Cynthia, aged fl. 30 yrs.; Anna, aged fl. 9 yrs.; Ritter, aged fl. 6 yrs.; Palmer, aged fl. 1.5 years. Other slaves mentioned: "Samuel, Gilbert, Ellbert, Eliza, Violet, and Josephine." 1850 Samuel Henry v. William Lowery, William McTur & Moses Keys, exec.'s of John Keys dec. Blount Debt In 1836, Henry was security in a bill executed by John Keys & Wm. Lowery payable to James Houston for $716. 1842, a judgment against defendants & plaintiff was granted to Houston in this amount for non-payment of bill. This case established that Henry has already satisfied his obligation, having paid the full $839.20 (original judgment + interest); Henry sought to recover this from William Lowery. 1850 James McMahan v. Henry Burum Blount Slander Trespass on the Case in Slander, $3,000 damages. McMahan sued Burum for slander, claiming Burum accused McMahan of stealing Burum's potatoes (on more than one occasion) & a plough & called McMahan a "good for nothing, lying, thieving, son of a bitch". According to McMahan, Burum also accused McMahan of committing larceny as a matter of habit. East Range: 9

1848 William G. Boyle, admr. of Erskin H. Wear, dec. v. William Kerr Blount Debt Dispute Erskin died; Robert Wear appointed his admr. Erskin had 3 notes against def. Kerr, upon which Robert obtained judgment but, before judgment paid, Robert died. Boyle replaced Robert & tried to enforce the judgments, but justice of the peace Edmund Wayman then allowed Kerr to produce (& offset) old 1838 accounts he held against E.H., all without notice to Boyle, compromising his ability to appeal. Boyle believes the offset was improper & barred by the statute of limitations. Witness: James M. Greenway. East Range: 9

1848 Ann Eliza Hannum v. William Wallace Blount Ejectment Wallace brought suit against Henry Hannum in 1835. Claimed to own lots in Maryville occupied by Hannum. Hannum claimed to be renting property from James White of Virginia. Court ruled in favor of Wallace. Supreme Court reversed decision & remanded case back to circuit court for retrial in 1839. Hannum died in 1845 & case was continued by his widow, Ann Eliza Hannum. Also names heirs: James, Ellen, Francis, William Alexander, & Kathleen Hannum. East Range: 9
