1907 W. A. Matthews v. The Kentucky Stave Co. Montgomery Contract Dispute and Damages Plaintiff alleged that he and the defendant manufactured staves under a contract. Defendant sold products manufactured from the staves, and under the contract, the plaintiff was to receive a salary and 25% profit from the staves he owned. 1907 Virgil A. Eatherly v. State Montgomery Murder, 2nd degree Victim: Charles Talley. Complainant appealed a charge of murder in the second degree. The victim worked for the Tennessee Central Railroad with the complainant as his foreman. They and some others traveled to Clarksville the night of the murder to attend a carnival. While in town, both the complainant and the victim got very drunk. While returning from the carnival, they got into an altercation, resulting in a fight and the complainant ultimately shooting the victim in the head. Middle Range:

1907 J. F. Brownlow et als. v. Red River Furnace Company Montgomery Breach of Contract Add. Com: W. J. Whitthorne. Coms leased a tract of land to the Def for the purpose of mining iron ore from it. However, Def later claimed there was not enough iron ore on the land, & tried to exit the lease via a clause in the contract. Coms claimed the Def falsified the evidence of the lack of minable ore & were in breach of contract in their attempts to exit the lease. 1907 Celia Vance v. A. J. Moore Montgomery Failure to Pay Complainant sold a parcel of land to the defendant for $125 to be made in $10 quarterly increments. Complainant claimed that defendant had failed to make a single payment and sought to have the debt satisfied and have the land the land sold to do so. 1905 Walter O'Neal v. R. W. Bogard, et al Montgomery Debt O'Neal & Slayden entered into a contract by which Slayden was to work 26 acres of O'Neal's land on shares. O'Neal did not furnish any supplies and Slayden took out a $150 mortgage from Sallee against his share of the crop for supplies. The two took the tobacco to be sold in Clarksville, Sallee sent the note to Bogard in Clarksville to be collected. O'Neal wanted the full amount paid to him including the interest from the note. 1905 Red River Furnace Company et al. v. The Tennessee Central R. R. Co. & The City of Clarksville Montgomery Election Dispute City of Clarksville taxpayers sued to enjoin City from issued bonds to pay $100,000 subscription for capital stock of Nashville & Clarksville Railroad (name changed to Tennessee Central Railroad Company). Dispute re election held to vote on City's participation in stock subscription, which railroad proposed in 1901 in order to construct railroad line from Nashville to Clarksville. 1905 McGregor, et ux. v. Gill Montgomery Personal Injuries Opinion only. This is an action to recover damages for personal injuries sustained by Mrs. McGregor. Gill was a livery stable keeper in Clarksville. In 1902, he was called upon to furnish a white driver to convey Mrs. Draughon, her son and Mrs. McGregor to Clarksville from a stranded steam boat in the river. Gill sent Hatcher. McGregor was injured when wagon was overturned. Decree in favor of defendant Gill. Judge of the opinion that he exercised reasonable prudence in selection of wagon driver. Middle Range: 35

1904 George Allen v. W. W. Stokes Montgomery Attachment Original bill was filed by Stokes as an attachment against Allen for the sum of $114.92. This debt originated from Stokes' furnishing Allen with supplies to make a crop of tobacco and corn. Allen had no property on which the attachment could be placed except the corn & tobacco grown on Stokes' farm. He moved said supplies from the farm to obstruct the ordinary process of law. 1904 E. R. Tyler, for use and benefit of Quarles Bros. v. C. D. Bailey, County Court Clerk Montgomery Debt Quarles Bros. was a firm of merchants engaged in the jewelry business. They hired E. R. Tyler, an auctioneer, to conduct an auction sale at which they sold their stock of jewelry to close their business. Tyler, being from Ohio, paid D. C. Bailey for the license tax of an auctioneer. 1904 Boyd Johnson, admr. v. J. J. Garrott Montgomery Recovery of Money/ Wages Garrott sold Evaline Dennis (dec.) a mule for $115.00, half paid in cash and for the remainder a title note was given. Boyd Johnson became Dennis' administrator after her death. Johnson fell ill for a long time, and the note became due, so Garrott took the mule back and sold it. 1904 Albert Brockman v. State Montgomery Possession of Illegal Weapons Brockman, aged 16, was accused of illegally possessing a pistol. The opinion outlines the incident and claimed that the pistol did not belong to Brockman but to Mrs. Barbary. He was visiting her home when he found the pistol lying on her bed and picked it up. He was holding it there when officers entered the home, looking to end the music playing in the home. When he saw the officers, Brockman ran with the pistol to hide it & was arrested. 1903 Wade & Gill v. R. Jesse Ellis, et al. Montgomery Land, Contract Dispute Additional defendant: R. J. Ellis. Wade and Gill sued R. J. Ellis for the remainder of the money owed for the sale of a parcel of land including a planter's warehouse. Eliis paid $3000 of the total of $7500, but then Gill advertised the property for sale again. Ellis filed to enjoin the sale, stating that Gill could not sell the property. R. J. Ellis by this time had mortgaged the property to his son R. Jesse Ellis and sold him the warehouse and its contents. Middle Range:
