1876 State v. Alec Kirby (col.) Montgomery Arson Kirby was arrested for being drunk and disorderly and was housed in the Calaboose. The Calaboose was a cell in the market house. The defendant was said to have started a fire on the cell floor and the cell caught on fire. He was found guilty of house burning and sentenced to four years in the Penitentiary. Middle Range: 20

1876 Lawson Clardy v. Robert T. Johnson Montgomery Property Damage In 1876 Clardy and George Beasley drove to Johnson's house in a wagon to find out if a stray sow had wandered to the property. Johnson said that the sow was there but had caused quite a bit of damage to his property. He asked Clardy to pay for the damage if he wanted his sow back. The two disagreed on the matter and eventually filed this suit to settle the matter. Middle Range: 36

1875 Wesley Flood v. H. A. Hatcher et al. Montgomery Debt Dispute Additional defendants: Wesley Evans & James Ewing Wilcox. Flood sold a tract of land for $1500 and a contract was signed but no money was paid down. Aftewards Flood bought a tract of land from the heirs of Wilcox for which he agreed to pay $1000. At that time he agreed to transfer to the Evans contract to the heirs for their part of the $10000. Deed was executed by James E. Wilcox & lien was placed until purchase money secured. James E. then bought land from Hatcher & transferred him the Flood Evans tract Middle Range: 20

1875 R. M. Baldwin v. L. Weill & City of Clarksville Montgomery Negligence Baldwin fell into a hole in a city owned street and broke his leg. The hole was dug by city workers and left unmarked and open. He became very ill and was in much pain, staying at the National Hotel in Clarksville for months. 1875 N. T. Allman v. Burrell Corban & Robert H. McFall, James H. & George W. Hoon, Nancy Hancock, & David Linsey Hancock Montgomery Lien Settlement Allman, in 1861 filed a bill of complaint against the def's in order to enforce a lien on a tract of land in Montgomery County. Allman alleged that he purchased the land at a sheriff's sale, that it had belonged to Burrell Hancock, then sold the land to Corban with flour mill machinery. Corban gave notes for the sale, but never paid the notes, and Allman sued to enforce the lien. Middle Range: 20

1875 Merritt & Fort v. F. A. Hannum et al. Montgomery Rent Dispute Court was ordered to rent out the property of the plaintiff, dec. Charles M. Stuart rented the said property in Nov. 1866 for a note of $415. Included in this property was 20 cabins. Those cabins were moved and Stuart claimed that this greatly damaged him much greater than the $415 owed. He claimed he never would have signed the contract had he known the cabins were going to be removed. Middle Range: 20

1875 M. C. Goodlett v. J. M. Collier, John A. Rollow, Ferdinand McBride, G. A. I. Enochs, & Joseph Hatcher Montgomery Contract Dispute and Damages In December 1868 Goodlett entered into a contract with Collier to form a farming partnership for the management of Goodlett's farm. The contract stated that Enoch had produced a crop of tobacco & other products, but was not ready to sell, therefore the proceeds from the product had not been distributed. Enoch became insolvent and this suit was filed to prevent him from selling these products to settle his debts, depriving Goodlett of the profits. Middle Range: 20

1875 John Hornberger, et al. v. Mrs. M. J. Hornberger, et al. Montgomery Equity Additional Plaintiffs: John D. Robins, Jacob G. Robins, D.D. & Sarah Hornberger, William Lockhart. Jacob B. Hornberger died in 1871 leaving a will. He had land in Montgomery & Davidson Counties, & a flower garden & cemetery at a house in Clarksville. He stated in the will that the city of Clarksville would be responsible for the perpetual upkeep of the cemetery, & that portion of the land would be left for that purpose. 1875 DeCoursey, Lafourcade & Co. v. Joshua Rice & William Moore Montgomery Attachment The pl's were a Philadelphia mercantile who sold goods to the def's valued at $188. Rice & Moore ran a mercantile in Clarksville, TN. The def's issued a promissory note as payment. Rice & Moore's business became insolvent, and they were sued to recover the debt owed. 1875 Aetna Insurance Co. v. Thomas Edgar Jones et al. Montgomery Breach of Bond Additional defendants: J. P. Y. Whitfield and Caleb H. Jones. The defendants were under the firm name, Jones & Whitfield. Aetna Insurance Company brought this case against the defendant, Whitfield & Jones, upon the bond of defendant, Caleb H. Jones, their local agent in Clarksville. Aetna Insurance Company alleged the defendant, Caleb H. Jones, received $11,943 from premiums and never paid Aetna Insurance Company. Middle Range: 21

1875 A. Hynes Ewing v. Charles M. Hiter & Gertrude Hiter Montgomery Deed Dispute In 1860, the defendants executed a deed which conveyed property set out to William Leonard Hiter in trustee for the use and benefit of themselves for life and then onto their children Charles & Gertrude. W. L. Hiter died in 1865 and then plaintiff was appointed as trustee. Juliet Hiter was also mentioned. Juliet, Charles Sr. & Gertrude Sr. were all dec. leaving their children as beneficiaries both of whom were under 21. Provision in deed allows trustee to sell land to pay off debts. Middle Range: 20

1874 Robert A. Mickle, J. G., Andrew B., Melville C., & Benjamin F. Mickle, G. W. & S. A. Clanton, Thomas & A. M. Cooper, v. Brown & O'Neal, exes. Montgomery Estate Dispute/ Settlement John C. Mickle died in 1859 w/ a probated will. Brown & Oneal were exe's falsely claimed the estate owed huge debts. They sold off $15k worth of property, including enslaved people, accepting notes. Slavery was outlawed, but the notes were still unpaid. Discussion of enslaved people including Worleigh, Judy, Harriet, Newton, Kate, Abbey, Milbon, Jane, Peter, Manus, Manuel, Jerry, Leamuel, Milly, Leannah, Jinney, Aleck, Lavinia & children, Vinny & 6 children. 1874 Polk G. Johnson v. C. M. Stuart Montgomery Debt Dispute In Dec. 1859 James Tait(?) contracted to sell a certain parcel of land in Clarksville to C. M. Stuart for the sum of $3000. Tait executed a bond of title to Stuart and Stuart executed 3 promissory notes for $1000 each. The promissory notes were then transferred to 1) Mrs. Amanda Munkford (2 notes) and 2) J. M. Jones (1 note). In April 1861, Jones transferred note by endorsement to J. W. Beaumont, trustee for the purpose of set out in a trust deed executed by Jones. Beaumont died w/o settling up. 1874 C. W. Greenfield, admr. with will annexed of J. N. Barker, dec. V. J. N. Barker et als. Montgomery Estate Settlement J. N. Barker died in 1873. At the time of his death he possessed 56 acres of land known as the Dunbar Leave track. In his will he devised that the property be divided among his wife and other heirs. There were also debts owed on the estate for which Barker had no resources to pay except by sale of the land. Medical expenses were due to Dr. Beaumont which were paid from Greenfield's pocket. The other debts coul only be paid from a sale of the land but the will did not authorize sale of land. Middle Range: 20

1874 Alexander Outlaw v. Larkin Bradley et al. Montgomery Debt Settlement Defendant: L. H. Baird. Additional parties: H. J. Oliphant, G. L. Keesee, W. B. Cross, John W. Matches, James H. Bradley, John Bradley, W. H. Marshall, Jane E. Bradley, A. Deland, Thomas J. Johnson, B. F. Clements, B. F. Bradley, James E.
